Please read these Terms and Conditions before using our services. These Terms govern all users who will use our services through this website (www.flashmop.com.au) or through our mobile app through which users can book a cleaner for the provision of cleaning services. By using our services, you accept to be bound by these Terms. If you do not accept the Terms of this Contract, please do not use our services.
FlashMop is merely a booking platform in order for households to book cleaners in their local area. The legal and binding transaction and contractual agreement that is occurring via the booking made on the App is wholly between the Household/ User and the registered cleaner.
This Agreement is governed by the laws of Western Australia, Australia. You and FlashMop submit to the exclusive jurisdiction of the courts of Western Australia, Australia.
FlashMop accepts no liability for any aspect of the User/ Household and Cleaner interaction, including but not limited to the performance or delivery of Services.
It must be acknowledged by Users/ Households that Cleaners do not require insurance in order to advertise their services via the FlashMop booking Platform. By agreeing to these terms you acknowledge that you understand this and are willing to accept the associated risks if any.
FlashMop has no responsibility and makes no warranty as to the truth or accuracy of any aspect of any information provided by Users& Cleaners, including, but not limited to, the ability of Cleaners to perform cleaning duties, or the honesty or accuracy of any information provided by Cleaners or the Users ability to pay for the Services requested.
FlashMop has no obligation to any User or Cleaner to assist or involve itself in any dispute between Users and Cleaners, although may do so to improve User experience.
Our platform is composed of two categories, one for the customers who hire cleaners through our App and the other for cleaners who post their services through our platform. Please take note that the cleaners are independent contractors. FlashMopare not your agent or broker to the transaction. FlashMop are merely a passive conduit in relating your booking directly to cleaners. The contractual agreement lies wholly between the household/ customer and the registered cleaner.
Who can use our services
Our booking platform is available only to legal entities and persons who are at least eighteen (18) years old and are otherwise capable of forming legally binding contracts under applicable law.
Our booking platform is available only to registered users. You will be required to register with FlashMop in order to make a booking. With respect to any registration, we may refuse to grant you, and you may not use, a user name or email address that:
belongs to or is already being used by another person;
may be construed as impersonating another person;
violates the intellectual property or other rights of any person;
is offensive; or
we reject for any other reason in our sole discretion.
You accept the Terms & Conditions by:
creating a User Profile; and
clicking to accept/agree to the Terms& Conditions.
By accepting the Terms& Conditions, you agree that you have carefully read and understood the Terms& Conditions. If you do not understand any part of the Terms&Conditions, you should seek independent legal advice.
You are responsible for maintaining the confidentiality of your password that you use to access our services. You agree not to transfer your password or user name, or lend or otherwise transfer your use of or access to this website and App, to any 3rd party. You are fully responsible for all Transactions (including any information transmitted in connection with any bookings) and other interactions with our platform that occur in connection with your username. You agree to immediately notify FlashMop of any unauthorised use of your password or user name or any other breach of security related to your account, your user name or the Website. You also agree that you will “log off” and exit from your account with the Website or mobile app (if applicable) at the end of each session. We are not liable for any loss or damage arising from your failure to comply with any of these obligations. If at any point you would like your account and details deleted from the app please email firstname.lastname@example.org.
Booking & Soliciting FlashMop Cleaners Directly
Upon making a booking, you will receive your booking confirmation via the ‘Home’ page on the App, along with a payment receipt issued by the 3rd party payment gateway ‘Stripe’. There are specific checklists for each type of clean that acts as an agreement between the Household/ User and the Cleaner. FlashMop, as the booking platform will provide the registered cleaner with your contact details, location and requested time. You agree not to bypass our system to book the cleaner outside our booking platform, FlashMop (website & mobile application). You may not solicit or persuade anyone working on behalf or for FlashMop to engage in business directly outside of the FlashMop App thus ceasing or reducing the amount of business you would normally do with FlashMop directly. You must ensure that all payments are paid through the FlashMop POS system ‘Stripe’ so a receipt can be issued. If you want to request a cleaner via the FlashMop booking platform you must do this through the App or website online booking portal, not directly with a FlashMop registered cleaner.
Text Messaging & Notifications
By creating an Account, you agree that the Services may send you text (SMS) messages and App notifications as part of the normal business operation of your use of the booking platform (FlashMop). You may opt-out of receiving text (SMS) messages from FlashMop at any time by following the directions on the message. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.
FlashMop may, in FlashMop’s sole discretion, create promotional codes that may be redeemed for Account credit, or other features or benefits related to the Services and/or a Third Party Provider’s services, subject to any additional terms that FlashMop establishes on a per promotional code basis. You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by FlashMop; (iii) may be disabled by FlashMop at any time for any reason without liability to FlashMop; (iv) may only be used pursuant to the specific terms that FlashMop establishes for such Promo Code; (v) are not valid for cash; and (vi) may expire prior to your use. FlashMop reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promo Codes by you or any other user in the event that FlashMop determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or these terms.
Cleaners (or the one who provides cleaning services) are independent contractors and are fully responsible for their own taxes with regard to their activity. They are also solely responsible for informing their local authorities of their FlashMopactivities. Cleaners are required to have their ABN, Driver license& Police Clearance. Your validity of registration which is up to our discretion shall depend on the validity of your ABN, Police Clearance and Driver’s License.
Upon registration, cleaners are required to upload a copy of their driver’s license and police clearance (obtained within the last 6 months). Police clearance will be checked upon cleaner registration and will not be requested again unless FlashMop administration is made aware of any serious issues that may arise in relation to the cleaner. Upon confirmation via FlashMop administration who will do their best to review the clearance, there is, however, no legal verification process. We will not be held liable for fraudulent police checks provided to us. Once clearance is obtained authority will then be given to the Cleaner to access the ‘Cleaners App’ and add in specific availability and postcodes they are willing to travel to.
It is the responsibility of the Cleaner to ensure all Australian Business requirements are kept up to date in case of any issues that arise in relation to the work conducted.
By agreeing to these terms and conditions, the Cleaner is confirming that all documentation and information provided via the Application or Website are true and correct at the time of registration and hold the responsibility to inform FlashMop if any of the details change.
Cleaners are also agreeing to the pricing structure set by FlashMop and the time slots associated with each type of clean as determined by the size of the house.
Cleaners Right of Refusal to clean
If the cleaners attends a property as per a booking made via the App or Website and at their own discretion conclude that their health and safety may be at risk due to the severely unkempt nature of the house, they have the right to refuse to clean the property.
The cleaner will take appropriate photographic evidence of the property in question and report it to the FlashMop support team immediately. If authorised by FlashMop, who deems the condition of the property to be unsatisfactory and potentially dangerous to the cleaner, similarly to the cancellation policy a 50% of total booking cost fee will be deducted from the account holder for the time and administration taken to attend the property. Any comments or reviews left by the User in relation to the cleaner who refused to complete the job can be removed at the discretion of the FlashMop support team. FlashMop have the right to remove the Users profile from the system so no other cleaner is exposed to a similar situation in the future. The User may be notified via email of their deleted account & blocked from the service.
Cleaners Location Information
Cleaners acknowledge and accept that FlashMop will collect location information via data such as GPS, IP address and WiFi to be able to provide precise location information to the User of the service. The User will be provided with updates on the cleaner’s location to enable an estimated time of arrival to be communicated to the User via a notification on the App.
Households agree to communicate or book the cleaners through the FlashMop booking platform. To protect the interest of the cleaners, we require the household to have sufficient funds on the payment method given within the App. We do not disclose the address to the Cleaners until the schedule and applicable payment method is confirmed via the 3rd party payment gateway ‘Stripe’.
Cleaner Ratings/ Feedback
After every clean, Users are able to rate the FlashMop cleaner via a star rating system, as well as give feedback on how the clean went. This system holds the cleaner accountable for their service.
Payment and Charges
If you request a booking via the FlashMop App you agree to pay the amount presented on your confirmation screen. Please note there is a $0.50c non-refundable booking fee even for cancelled bookings.
FlashMop may add new services or amend fees and charges for existing services from time to time at their sole discretion.
Users agree that at the time of Booking, your payment details will be transferred to our secure payment gateway ‘Stripe’. We will receive payment upon successful booking completion. Users warrant that the nominated payment method has sufficient funds to perform the transaction. We will hold the cleaning fee until it is cleared.
We have taken all practical steps from both a technical and systems perspective to ensure that all of your information is well protected. A secure payment gateway ‘Stripe’ is used to process all transactions and credit card details. FlashMop does not give any warranty or make any representation regarding the strength or effectiveness of the secure payment gateway and is not responsible for events arising from unauthorised access to your information. By agreeing to these Terms and Conditions you are agreeing to the terms and conditions of the secure payment gateway ‘Stripe’ as found at https://stripe.com/au/privacy.
All refund requests must be made within 24 hours after cleaning otherwise you have waived your right to such claim. All Refund Requests must be accompanied by thorough details and photographs provided to the FlashMop support team outlining the unacceptable cleaning that has occurred (within 24 hours after the clean has been completed). All refunds will be determined and final decision made at the discretion of the FlashMop support team.
Security and Fraud Controls:
Both Stripe and the Flashmop App will do all they can to ensure your data is kept secure and safe. In the unfortunate case that data is hacked or fraud of some description occurs, neither Stripe or FlashMop will be held liable. We will however do all we can to assist the Cleaner/Household in recovering any lost funds or resolving any issues.
Transactions between the Cleaners and Users
You understand that we are not a party to, or have no involvement or interest in, make no representations or warranties as to, and have no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between the Users and the Cleaners.
FlashMop operates the Website and mobile phone applications as a third party facilitator for the Cleaning Services and provides you with the platform to book the Cleaning Services.
FlashMop is not an agent or broker for you. You enter into any transaction with FlashMop on behalf of a Cleaner entirely at your own risk. The contractual agreement for all bookings made via the FlashMop platform is between the user/ household and the cleaner.
FlashMop uses their best efforts to monitor the Cleaning Services offered by a Cleaner, however, does not make any representation as to the safety, quality, condition or description of any products used or Cleaning Services provided by the Cleaner. Any issues regarding safety or quality should be notified to the FlashMop support team, who will then pass the issue onto the Cleaner designated to your Booking.
Damage & Missing Goods Policy.
) You hereby acknowledge and agree that in no event will FlashMop be liable to you or any third party for any actual or alleged damages arising out of or related to your Clean booked via the FlashMop platform, including, without limitation, actual or alleged damages to your home resulting from a Clean performed by a cleaner registered with the FlashMop booking platform.
) You understand that it is your responsibility to remove all valuables from your home before a Cleaner arrives to clean your home.
) You understand that a small gift may be supplied complimentary after each clean and made to be consumed or used at your own personal discretion. FlashMop accepts no liability for any alleged damages arising from this consumption or use.
) You hereby acknowledge and agree that in no event will FlashMop be liable to you as the User or Cleaner or any third party for any alleged or actual losses resulting directly or indirectly from a Clean performed by a Cleaner using the FlashMop booking platform and/or your failure to adhere to your obligations under this Agreement.
We are sure that all Customers will fully understand the commitment that the cleaners have to make when a booking is made, in terms of preparations and putting aside the time allocated for the bookings, which means no other bookings may be made in that time slot. All this equates to a potential lost revenue, lost time and possible wastage for cleaners.
Therefore, our cancellation/ rescheduling policy is as follows:
Up to 24 hours prior to the booking schedule, we will charge you 50% to reschedule or cancel the booking. This is to cover basic administration costs and some of the transaction fees incurred.
More than 24 hours prior to the booking schedule are not subject to any cancellation fee.
You cannot amend, extend or cancel a Booking during the performance of the Services.
If the Cleaner is unable to fulfil a confirmed booking (in full or part)the user will be notified of this change and will have the option to book an alternative cleaner or reschedule the booking. Alternatively, the booking can be cancelled at no cost to the user (even if it is less than 24 hours’ notice) via correspondence between the FlashMop Support team and the Cleaner.
FlashMop may at its discretion terminate your use of, or access to, the Website or mobile phone applications at any time. If this happens we may notify you by email. If your use of the Website or mobile phone applications is terminated:
you are no longer authorised to access the Website or mobile phone applications or use any other FlashMop services with the email address you used to register with the Website or mobile phone applications or any other email address you possess;
you will continue to be subject to and bound by all restrictions imposed on you by the Terms; and
all licenses granted by you and all disclaimers by FlashMop and limitations of FlashMop’s liability set out in the Terms or elsewhere on the Website or mobile phone applications will survive termination.
You may terminate this agreement by emailing FlashMop at Support@FlashMop.com.au FlashMop will disable your User Profile within fourteen (14) days of receipt of the email requesting termination of your User Profile.
FlashMop reserves the right to deduct any outstanding fees and charges owing to FlashMop and/or the Cleaner on your User Profile prior to disabling it.
Dispute Resolution Policy
FlashMop will use reasonable endeavours to mediate any dispute concerning the use of the Website or mobile phone applications.
Disputes in relation to the Cleaning Services carried out by a Cleaner or any other issue will be referred, where appropriate, to external dispute resolution services or authorities.
When a registered user orders and pays for cleaning services through the FlashMop booking platform and the cleaning service has already been performed, and if the registered user is not satisfied with that cleaning service, then the registered user is eligible for our Money-Back Guarantee provided that the registered user reports the issue within seventy-two (72) hours of the booking time to our support email, email@example.com. After full investigation, FlashMop will either refund the registered user’s amount for such cleaning service, or, alternatively, FlashMop will have the applicable cleaning service re-performed. If the registered user elects to have the cleaning service re-performed and the registers user is still not satisfied with the cleaning service after it has been re-performed, FlashMop will refund the registered user’s payment amount for such cleaning service. FlashMop’s Money-Back Guarantee does not apply to any other cost, liability, damage, injury, or claim arising from or in connection with the cleaning service performed. In any instance where a Cleaning Partner is found to be in breach of our terms and conditions, FlashMop may also elect to withhold up to 100% of the total payout for their services.
The website and app, the materials, the content and the related services and products are provided “as is” and “as available.” We disclaim any representations or warranties regarding the website and app, the materials, the content and the related services, whether express or implied, including but not limited to, those of merchantability, fitness for a particular purpose, title and non-infringement. We make no representation or warranty as to the accuracy, reliability, timeliness or completeness of any material on or accessible through the website or app.
It must be noted and understood that cleaners registered on the App are not required to have Public Liability Insurance or any form of Insurance in order to register as a cleaner via the FlashMop App or Website. If the User/ Household requires a cleaner to have insurance in order to enter their home, they will need to seek alternative methods to book a cleaner (not via the FlashMop booking App as we cannot guarantee whether a cleaner has insurance or not). By accepting these Terms and Conditions you are acknowledging that you are aware that the Cleaners using the App may not have insurance of any form.
Limitation of liability.
In no event shall FlashMop, its subsidiaries or affiliates, or any of their respective employees, officers, members, managers, directors, agents or representatives be liable for any indirect, incidental, special or consequential damages arising out of:
The website or app;
Your use of or inability to use the website or app; or
The acts or omissions of FlashMop, in each event, even if FlashMop or such party has been advised of the possibility of such damages.
Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so these limitations or exclusions may not apply to you. We are not responsible for any unauthorised access to or alteration of your submissions, transmissions or data or for any material or data sent or received or not sent or received. We are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party, or any infringement by a third party of another intellectual property, privacy or other rights. In no event will our total liability to you for all damages, losses and causes of action (whether in agreement, tort or otherwise) arising from or related to these terms, the website or the App, or your use of or inability to use the website or App exceed the amount paid by you, if any, for using or accessing the website or App.
You agree to indemnify FlashMop, on demand, against any claim, action, damage, loss, liability, cost, charge, expense or payment which FlashMop may pay, suffer, incur or are liable for, in relation to any act you do or cause to be done, in breach of these Terms.
General limitation of liability
We will not be liable to you in contract, tort or equity in relation to any direct, indirect or consequential loss you incur in relation to the contents or use of or reliance on Site Content or otherwise in connection with the Website or mobile phone application.
Cleaning Services Liability
To the extent permitted by law, FlashMop will not be responsible and will be excluded from all liability, for any loss or damage whatsoever (including personal injury, loss of life and damage to property) that you or another person may suffer in connection with the offer or supply of (or default in supplying) the Cleaning Services booked via the FlashMop booking platform.
This Terms of Service constitutes the entire agreement and understanding between FlashMop and You regarding the use of our booking platform you made on this website or app and supersedes any and all prior oral or written understandings or agreements between FlashMop and you regarding the use of our services.
FlashMop reserves the right, at its sole discretion, to modify the Services or to modify these Terms at any time and without prior notice. If we modify these Terms, we will either post the modification on this website or through the app. By continuing to access or use our services after we have posted a modification on website or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using this website/ application and our services.
